The Census Bureau projects that by 2030 the U.S. will have more people who are 65 and older than children. How will this development affect elder law?  As the population gets older, and families become smaller and more spread out, it becomes ever more crucial to develop a plan to manage a future incapacity. Elder law will continue to focus on “hard issues” such as choosing a medical proxy or how to pay for care, but will also need to address “soft issues” such as how to avoid becoming so isolated that you become vulnerable to scam artists or untreated illnesses.

What are the most common issues that you handle in your elder law practice?  Many families need a guardian or conservator, either for an incapacitated relative who did not do effective planning prior to their incapacity or for an incapacitated minor child who is turning 18. Aging clients are concerned about paying for their own long-term care and avoiding impositions upon their younger family members. Parents of all ages are concerned about establishing and perpetuating proper support systems for their special needs children.
