What trends do you see developing in employment law?
“With the passage of the Americans with Disabilities Amendments Act (ADAA), we will see more disability claims filed by employees.  In the past, the focus was on determining whether the employee had a disability.  Now, given the broader definitions of disability and major life activities under the ADAA, coverage will be assumed in most cases, and the primary focus will be whether the employer adhered to the requirements of the statute.”

Has the recession changed the relationship between employers and employees?
“Yes. Smart employers are using the recession as a means to build loyalty amongst their existing employees by opening the channels of communication regarding the company’s financial well-being.  Employers that are more transparent and honest regarding company expenditures and cutbacks will garner more loyalty as the employer of choice when the economy rebounds and the employees have more employment options.”
